Even if Delhi is not a full-fledged state, its Chief Minister cannot be denied the right to have officers of his choice to run his government. There was an ugly row over a Chief Secretary's appointment. Arvind Kejriwal had asked for, and was denied, the services of a Magsaysay awardee officer who had attempted an AIIMS clean-up. The Centre had transferred 11 Delhi officers before the CBI arrested Principal Secretary Rajendra Kumar, an IIT batchmate of Kejriwal, confirming the AAP charge that there is a “conspiracy to paralyse the Delhi Chief Minister's office”. On December 15, 2015, for the first time, the CBI raided a Chief Minister’s office without his permission and seized documents from Principal Secretary Rajendra Kumar’s office.
The CBI alleges Rajendra Kumar is the kingpin of a Rs 50-crore computer purchase scam, which happened during Chief Minister Sheila Dikshit’s tenure. There is an alleged water tanker scam, which also happened during Congress rule. But it is the AAP MLAs and AAP government officers who are being targeted. When after the December 15 raid at the CM’s office the Rajendra Kumar case went to court, CBI Special Judge Ajay Kumar Jain said the document seizure was in violation of the CBI manual, the FIR was registered on oral information, the CBI “flouted” procedures and was “conspicuously ambiguous” in its investigation. Days before the Principal Secretary’s arrest, this particular judge was transferred. Behind these various Central Government actions a pattern can be discovered — and it should trouble every stakeholder in our constitutional order.
Last month the Centre returned all the 14 Bills the Delhi Assembly had passed, saying “proper procedure was not followed”. By repeatedly arresting AAP leaders and their trusted government officers as well as holding back important legislative Bills the Union Government has lent weight to Kejriwal’s charge that “Modiji is taking revenge of (the) BJP’s defeat in Delhi”. While there can be no justification for corruption at any level by any one, excessive focus on one particular state and one political party makes the Centre’s anti-graft steps deeply suspect.
